End-User License Agreement ("EULA" hereafter) of Beautiful Void Audio ("BVA" hereafter) sound effects, instrument libraries, synth presets and all other sound assets (all of which will be refered to as "sound products" hereafter).
This EULA is a legal agreement between you and BVA.
This EULA governs your acquisition and use of sound products directly from BVA or indirectly through a BVA authorized reseller or distributor.
Please read this EULA carefully before completing the installation process and using the sound products. It provides a license to use the sound products and contains liability disclaimers.
By installing and/or using the sound products, you are confirming your acceptance of the sound products and agreeing to become bound by the terms of this EULA.
If you are entering into this EULA on behalf of a company or other legal entity, you represent that you have the authority to bind such entity and its affiliates to this EULA.
If you do not have such authority or if you do not agree with the terms of this EULA, do not install or use the sound products, and you must not accept this EULA.
This EULA shall apply to all sound products supplied by BVA.
License
BVA hereby grants you a personal, non-exclusive license to use the sound products on your devices in accordance with the terms of this EULA.
You are permitted to load the sound products (for example a PC, laptop, mobile or tablet) under your control. You are responsible for ensuring your device meets the minimum requirements of the sound products.
You are also permitted to:
- Edit, alter, modify, adapt, or otherwise change the whole or any part of the sound products in the context of your own musical works, both for commercial and non-commercial use.
However, you are not permitted to, under any circumstance:
- Edit, alter, modify, adapt, or otherwise change the whole or any part of the sound products in order to sell them as your own sound products.
You are also not permitted to sell the sound products as is, or repackage the sound products to sell them as your own sound products.
Ownership
BVA shall at all times retain ownership of the sound products downloaded by you. All sound products supplied by BVA are and shall remain the property of BVA.
If you fail to comply with any term of this EULA, this agreement will be terminated. Upon such termination, the licenses granted by this EULA will immediately terminate and you agree to stop all access and use of the sound products.
Any musical works which you have created in compliance with this EULA will not be subject to termination - only those works or creations which violate this EULA.
Governing Law
This EULA and any dispute arising out of or in connection with this EULA shall be governed by and construed in accordance with the laws of the United States of America.
